ACCEPTABLE USE POLICY

This Acceptable Use Policy (“AUP”) governs your use of the Services and is incorporated by reference in Astral Servers Terms of Service. All meanings defined in this AUP have the meanings provided in the Terms of Service; unless otherwise stated. Astral Services reserves the right to modify this AUP at any time with or without notice.

The Services provided by Astral Servers is only to be used for lawful purposes. By accepting Astral Servers Terms of Service, you hereby consent to comply with all applicable laws, rules, and regulations in connection with the use of your Services. Astral Servers reserves the right to refuse service to anyone for any reason. Any material in our judgment, that violates or conflicts with this AUP in any way, shape, or form may be removed or disabled with or without notice.

Failure to respond to an email from our support department within the specified time frame may result in the immediate suspension or termination of your account and/or Services provided to you by Astral Servers.

PROHIBITED USES

Use of the Services that infringe upon another person or party’s intellectual rights and/or property is strictly prohibited. This includes but is not limited to;

  • Unauthorized distribution or copying of any copyrighted work, such as but not limited to; books, photographs, movies, software, etc.
  • Selling or offering to sell counterfeit merchandise will result in the immediate termination of your account with or without warning.
  • Any account found to be in repeated violation of this agreement will be suspended or terminated.

PROHIBITED MATERIAL

  • Bitcoin Miners
  • PayDay Loan Site
  • Anonymous or Bulks SMS Gateways
  • Fraudulent Sites
  • Sites promoting illegal activities or terrorism
  • Hacker focused sites/programs/archives
  • Forums and/or websites promoting or distributing pirated content, illegal content, and/or warez
  • Lottery and Gambling sites
  • Sale or distribution of a controlled substance without proof of appropriate permits
  • Broadcasting or Streaming of Live Sporting Events
  • File Dump and Mirror scripts
  • Topsites
  • IRC Bots and Scripts
  • IRC Servers
  • Proxy Anonymizers and Scripts
  • Proxy Sites
  • IP Scanners
  • Bruteforce Applications, Scripts, and Programs.

CHILD PORNOGRAPHY

Content harmful to minors as determined by Astral Servers sole discretion is strictly forbidden. This includes but is not limited to child pornography and content perceived to be child pornography. Any Service found to host child pornography or linking to child pornography will be terminated immediately without notice. You WILL be reported.

OTHER PROHIBITED CONTENT

Astral Servers reserves the right to refuse service to any entity or organization. Any material that, in our judgement, is threatening, obscene, illegal, or violates our Terms of Service or this AUP may, and will most likely, be removed from our servers, with or without notice.

NO SPAM POLICY

Astral Servers has a strict zero spam policy against the sending of unsolicited email, bulk emailing, and spam. Purchasing or selling of lists (“Safe Lists”), will also be treated as spam. Astral Servers may terminate the account of any User who sends our spam with or without notice.

Websites advertised via spam may not be hosted through Astral Servers. This includes but is not limited to, spam sent via phone, fax, postal mail, email, usenet or newsgroups, and/or instant messaging (IM).

This policy prohibits any entity or organization listed in the register of known spam operations, or ROKSO, from using our servers and/or services.

Any User account which results in our IP space being blacklisted will be immediately suspended and/or terminated.

Astral Servers, at our sole discretion, reserves the right to hold the account holder liable for any unsolicited email and a cleanup fee will be collected. You agree as the account holder not to send unsolicited email; else you agree to be held responsible and pay any charges that might accrue from blacklist removal. Astral Servers also reserves the right to disable or alter any Services or website, content, account, database, or other component that does not comply with our policies, or to make any such modifications in an emergency that we deem necessary at our sole discretion.

MAILING LIST POLICY

There is no rate-limit for sending emails on our VPS platform; however, we advise that you throttle email sending to avoid high load problems on your server.

All mailing lists on Astral Servers must be double opt-in lists.  A double opt-in list is one to which a user explicitly subscribes themselves and then confirms that their email address is indeed theirs.  Confirmation is often done by sending a confirmation email to the specified email address of the user.  Double opt-in ensures that the user wants the subscription of the mailing list and prevents someone else from signing up the email address for unwanted emails.  Sending emails to any mailing list that was given, purchased, or otherwise not double opt-in is considered spamming and may result in suspension or termination.

Mass mailing scripts must be able to handle and record double opt-in information, including documenting the sign-up IP address, date and time of the sign-up, double opt-in verification IP address, and time of the verification.  An opt-out (unsubscription) option must be provided to recipients of mass emails, and email addresses that bounce back should be removed from the mailing list.  If a script does not comply to these terms, Astral Servers reserves the right to suspend or terminate the associated hosting account.

Any unsolicited e-mail sent may result in suspension or termination of the offending account at Astral Servers’s discretion.  We have zero tolerance of sending unsolicited e-mail and other forms of spam.

SLANDER/DEFAMATION POLICY

Astral Servers is located in the United States of America and as such, is regulated by U.S. law. Pursuant to Section 230(c) of the Communications Decency Act, Astral Servers will not remove allegedly Slanderous or defamatory material hosted with us unless the material in question has been found defamatory by a court of law, as evidenced by a court order.

Astral Servers is not a publisher of User content and will not be placed in a position to investigate the veracity of individual defamation claims.

If Astral Servers were to receive a court order that indicates that material is found defamatory, libelous, or slanderous in nature; access to such material will be disabled. In any case in which a United States court has placed an injunction against specified content or material being made available, we will comply to remove and/or disable access to the material in question.

AUP VIOLATIONS

Astral Servers may, but is not obligated to, monitor your account, website, or Service for any subsequent violations. The occurrence of additional violations may result in the immediate termination of your account.

Astral Servers reserves the right to terminate your Services with or without notice upon any violation of this AUP. If applicable, violations shall be reported to the appropriate law enforcement agency.

Upon receiving notification from Astral Servers in regards to a breach in the Term of Service or this AUP, you will have forty-eight (48) hours to respond, either via support ticket or through email.
